  • Notable Litigation Resolutions and Representations

     Text Obtained a temporary restraining order, preliminary injunction, and permanent injunction against a foreign bank enjoining the collection of a standby letter of credit and obtained an award of attorneys' fees on behalf of the applicant of the standby letter of credit.


    Obtained a temporary restraining order and preliminary injunction in favor of directors of $30 million closely a held corporation who were being ousted by other directors in a battle for control of the corporation and forced a shareholders' vote, which gave control of the corporation to the ousted directors.


    Co-counsel for a former employee in a disability discrimination lawsuit against her former employer in which the recovery was over $1 million in compensatory and punitive damages.


    Obtained dismissal of a federal savings bank in an action brought under California's False Claims Act.


    Obtained dismissal of a national bank a consumer class action involving fax fees.


    Obtained dismissal of a national mortgage lender in a consumer class action involving usury issues.


    Obtained summary judgment based upon ERISA preemption in favor of a company in a dispute with an employee over the denial of medical benefits.


    Obtained summary judgment in favor of a national steel manufacturer against a claim of a religious discrimination failure to accommodate.


    Successfully represented a brokerage firm in multi-million-dollar NASD arbitration with two of its former high-level executives/brokers involving compensation issues.


    Obtained a defense verdict for a regional brokerage firm and a securities dealer against allegations of fraud and churning in a jury trial in Los Angeles Superior Court.


    Supervised outside counsel in several lender liability disputes that were successfully resolved by motions for summary judgment in favor of the lender.


    Represented an insurance company and a national bank in consumer class action regarding the payment of death benefits.


    Supervised outside counsel of a nationwide finance company in consumer disputes involving credit reporting and debt collection.


    Supervised outside counsel of a nationwide mobile home lender in consumer disputes involving repossessions, credit reporting, debt collection, forceplaced insurance, and dealer disputes involving inventory financing.


    Represented a former outside director of a failed savings and loan in an action brought by the FSLIC and negotiated his dismissal from the action for a nominal amount.


    Represented a Japanese consumer electronics manufacturer's U. S. sales subsidiary in disputes regarding terminations of its distributors and warranty reimbursement issues under California's Song-Beverly Consumer Warranty Act.


    Represented parties in a number of real estate-related disputes, including landlord-tenant, mold, and construction defects.


    Represented limited partners as plaintiffs in a dispute with the general partner involving securities fraud issues.


    Represented management in litigation with dissenting shareholders in a going-private transaction.


    Represented a pension fund service provider in an ERISA action with plan participants alleging failures to execute stock trades, which involved complex accounting issues.


    Represented real estate developers in disputes with homeowners and homeowner associations arising from the conversion of multi-unit townhome projects from apartments to condominiums.


    Represented a Japanese trading company in steel dumping action in Portland, Oregon.
